CaseKeepers consists of a mobile app and web application that enables individuals (“clients”) to collect and securely store evidence as events occur. The mobile app enables users to quickly take photos, audio or video recordings, capture text messages and emails, and annotate them to create date/time-stamped “journal entries”. The client web application augments this capability by enabling users to create entries with additional types of attachments (e.g., financial statements, police and medical reports, legal documents). Users can “tag” their journal entries to support sort, search and retrieval functions by indicating where an event occurred, who was present, and what type of behavior was exhibited. All entries are stored in a cloud-based database that all parties in a case can access from any Internet-connected device or computer.

CaseKeepers provides users the ability to share their repository with any licensed professional serving them (e.g., attorney, psychotherapist, physical therapist), thereby facilitating collaboration and enabling professionals to better manage their clients’ cases. A desktop version of CaseKeepers for professionals enables professionals to access their clients’ journal to sort, search, and retrieve entries and attachments using clients’ tags.

CaseKeepers, Inc. is dedicated to protecting the privacy of the users of our products and of the information that is transmitted and stored by our system. CaseKeepers database repository is developed with appropriate levels of security. CaseKeepers maintains access logs for all client documents to facilitate admissibility in court, and is fully compliant with HIPAA regulations.

Your Consent – PLEASE READ CAREFULLY

By installing the CaseKeepers mobile app on your mobile app, or activating a Client or Professional account on the CaseKeepers web application, you agree to the terms and conditions set forth in this Privacy Policy, including to the collection, transfer, storage, and processing of your Personal Information. If you disagree to any term provided herein, you may not install, activate, or use any of the CaseKeepers applications in any manner and you are requested to promptly remove the mobile app from your device and cease accessing the CaseKeepers web application .

Users Personal Information

We understand the importance of protecting you from the unauthorized use of information you provide in the course of using our applications. Except as disclosed in this policy or our User Agreement, we will not give away, sell or otherwise disclose any information that personally identifies you. We may, however, obtain, use and disclose personal information about you for the purpose of verifying your identity and the professional credentials of professionals (e.g., attorneys, therapists) using CaseKeepers.

We may also disclose personal information about you if we are compelled to do so by law or by valid legal authority. We may disclose personal information if we have your express permission to do so, or if the disclosure is to our service providers and/or vendors to assist us in providing our services, or for user verification purposes. We also use IP addresses and other traffic indices to analyze trends, administer our web applications and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

Aggregated De-Identified, De-Personalized Data: We may use your personal information in a de-identified format. In the User Agreement, you transfer and assign to us all right, title and interest in and to all such de-identified personal information, and you agree that we may use all such de-Identified personal information for research purposes to expand and improve the services we offer, and that you have no interest in such de-identified personal information, or in proceeds from our use of such information.

Protected Health Information

Our User Agreement sets forth our obligations as our behavioral health and medical provider users' business associate under the administrative simplification provisions of the Health Insurance Portability and Accountability Act of 1996 and its privacy and security regulations (HIPAA), and under the privacy and security provisions of the Technology for Economic and Clinical Health Act of 2009 (the HITECH Act). If you are a Covered Entity we will comply with the Business Associate provisions of our User Agreement. We will also comply with provisions of the HIPAA Security Rule that apply to business associates under the HITECH Act, and the privacy and security provisions of the HITECH Act that are applicable to business associates.

Obligations of Professionals

You agree that you will use other persons' information available on or through this site (whether or not protected health information) strictly in accordance with applicable laws and regulations, and you will ensure that others under your control, such as employees, contractors, or vendors who have access to such information will also comply with applicable laws and regulations. You are solely responsible for obtaining and maintaining all patient consents and authorizations necessary for your use of the site and the systems to which it provides access.

Account Access

To access your account, you must provide the identifier you chose when you created your account. You are allowed to change your password as desired, but it must comply with our password security protocol. We log and audit system use in order to ensure system security. If we have questions about your use of the system or your account, we reserve the right contact you to ask for your assistance in an investigation, and/or to unilaterally suspend your account credentials pursuant to such an investigation.

Security

We take reasonable measures to maintain the security and integrity of our applications and user information and prevent unauthorized access to it or use thereof through generally accepted industry standard technologies and internal procedures. Please note, however, that there are inherent risks in transmission of information over the Internet or other methods of electronic storage and we cannot guarantee that unauthorized access or use of your Personal Information will never occur. CaseKeepers, Inc. SHALL NOT BE RESPONSIBLE OR LIABLE FOR UNAUTHORIZED ACCESS, HACKING, OR OTHER SECURITY INTRUSIONS OR THE THEFT, DELETION, CORRUPTION, DESTRUCTION, DAMAGE, OR LOSS OF ANY DATA OR INFORMATION THEREOF.

You are solely responsible for (1) maintaining the strict confidentiality of your user name and password (collectively, "User ID"), (2) not allowing other persons to use your User ID to access your account, (3) any damages or losses that may be incurred or suffered as a result of your failure to maintain the strict confidentiality of your User ID, and (4) promptly informing CaseKeepers, Inc. in writing of any need to deactivate your User ID due to a potential or actual security breach. CaseKeepers, Inc. is not liable for any harm related to the theft of your User ID, your disclosure of your User ID, or your authorization to allow another person to access your CaseKeepers account using your User ID. You agree to immediately notify CaseKeepers, Inc. in writing of any unauthorized use of your User ID. In the event that damages are assessed, you agree that such damages shall not exceed the value of the total fees paid by you to CaseKeepers, Inc.

International Data Transfer

We reserve the right to transfer data about you and/or entered by you, including Personal Information, to third party service providers (e.g., data management, storage, and security providers) to other countries or jurisdictions around the world. This includes transferring information to a country or jurisdiction that does not have the same data protection laws as California. You consent to such transfer of information and you agree that the laws of such other jurisdictions will apply to your data.

Data Collected Automatically

When the CaseKeepers mobile app is used, the user’s IP address will automatically be provided to the CaseKeepers database. Also, the GPS location of the user's mobile device will be provided to the database, which may be used to enhance the informational integrity of stored evidence and attachments.

Material Provided by Professionals

You may provide content or material to your own account or that of your clients via your CaseKeepers account. Any information, material or work product you provide will remain your property, and we will not disclose, market, license or sell such material or content to any party. You warrant and agree that any material you provide will not infringe on the intellectual property or other rights of others, and will not be otherwise unlawful, infringing, threatening, libelous, defamatory, obscene, pornographic, or in violation of any law. You are responsible for safeguarding the privacy of your and your clients' personal information when you share your materials with them with the intention of their providing responses to in return.

Decision Support Information

Information might be available on our website to assist you in making decisions about your situation (divorce, custody dispute, therapy). The information and materials available through our website are for informational and educational purposes only and are not intended to constitute professional advice, diagnosis or treatment, or to substitute for professional judgment. You assume full risk and responsibility for the use of information you obtain from or through our website, and you agree that CaseKeepers, Inc. is not responsible or liable for any claim, loss, or liability arising from the use of the information. CaseKeepers, Inc. does not recommend or endorse any attorney or provider of health care services, and the appearance of materials on this site relating to any such services is not an endorsement or recommendation of them.

Applicable Law

Any claim relating to the use of CaseKeepers’ applications shall be governed by the laws of the State of California.

Minors

Minors under the age of eighteen (18) are not permitted to use any of the CaseKeepers applications. All CaseKeepers applications are intended for users age eighteen (18) and older. We reserve the right to request proof of age at any time so we can verify that minors under the age of eighteen (18) are not using our applications. If we learn that we inadvertently collected Personal Information from children under the age of eighteen (18), we will delete that information as quickly as possible. Other Issues

We reserve the right to make changes to our privacy policy at any time without prior notice, and to apply the changes to information received by us prior to the effective date of the change. Please be sure to check this page periodically for updates to this policy.
